These Terms and Conditions of Sale (“Terms and Conditions”) govern any sale of goods or services between LUXASIA Group Pte. Ltd., its subsidiaries, affiliates, and/or distribution partners (collectively “LUXASIA”, “seller,” “we,” “us,” or “our”) and the buyer (“you” or “customer”) when you make an offline purchase at a physical store, retail outlet, or pop-up event managed by LUXASIA. By purchasing our goods or services offline, you agree to these Terms and Conditions.
- Entire Agreement
These Terms and Conditions, along with any issued tax invoice, constitute the complete agreement between LUXASIA and the customer. LUXASIA reserves the right to amend these Terms and Conditions at any time. We recommend that you periodically review these Terms and Conditions for any changes or updates.
- Pre-Order
We may provide pre-order options for certain goods that are not yet available for sale. When you place a pre-order for such goods, you are required to pay the full price of the product upfront. If we cannot fulfill your pre-order due to stock issues, you will receive a full refund of the purchase price.
If you have pre-ordered goods from LUXASIA and chose the self-collection option, we will notify you (based on the contact information provided by you) when your pre-order is ready for collection. Pre-orders should be collected within a reasonable timeframe, and in any event, no later than 90 days from the date of notification.
If you have pre-ordered goods from LUXASIA and chose the delivery option, we will ship the goods to the address you provided. LUXASIA is not responsible for any losses, damages, or expenses you or any other person may incur due to delays in delivery that occur: (a) at your request, (b) because you are unable or unwilling to accept the delivery, (c) due to insufficient access to the shipping address, or (d) for any other reason beyond LUXASIA’s control. If delivery is delayed for any of these reasons, you cannot cancel or invalidate your purchase contract with LUXASIA.
- Personalised Goods
If you purchase goods and opt for our personalisation services, such as hot stamping or engraving, you must provide accurate personalisation details. Returns or refunds are not accepted for personalised goods delivered according to your specifications.
- Goods Sold “As-Is”
All goods are sold on an “as-is” basis, and ownership and risk pass to the customer upon collection or delivery of the goods.
- Inspection and Acceptance
Upon receiving the goods and the tax invoice, you are advised to inspect the items and report any damage within a reasonable timeframe. Items sold as “special offers” or “sale items” are sold as inspected, and you acknowledge that these items are in satisfactory and acceptable condition.
- Returns and Refunds
We do not accept returns for change of mind. Goods labelled as discounted, special-order, or non-exchangeable at point of sale are not eligible for exchange, return or refund.
For incorrect, defective, or damaged item, exchanges, returns or refunds may be offered at our discretion. Any exchange, return or refund must be done at the store from which the purchase is made, within seven (7) days of purchase of the goods, in its original condition, including all packaging (which must remain unmarked and not defaced), documentation tags, and accessories, along with the original tax invoice or receipt. Items purchased as part of a set or multi-item pack must be returned as a whole set.
We reserve the right to review and reject any claim that does not meet the above requirements and to make the final decision in the event of any dispute.
- Pricing and Payment
The contract price is as stated on the invoice, inclusive of any applicable taxes. Payments must be made in the currency specified on the invoice and in the specified manner.
- Limitation of Liability
To the maximum extent permitted by law, and subject to applicable local consumer protection laws and regulations, we will not be liable for any claims arising out of incorrect or improper use of goods or services purchased from us, including usage that does not comply with product instructions or is otherwise unexpected or unreasonable.
Except as expressly provided in these Terms and Conditions and to the extent permitted by law, all implied conditions, warranties, guarantees, representations, undertakings, rights, duties or liabilities whether arising by implication of law, by statute or otherwise, are hereby expressly excluded.
Notwithstanding anything in these Terms and Conditions, certain local legislation may impose non-excludable guarantees on LUXASIA that goods are of acceptable quality or that services will be provided with due care and skill, with certain remedies available to consumers for certain breaches of such guarantees. To the extent that such legislation applies, these Terms and Conditions must be read subject to these statutory provisions, and nothing in these Terms and Conditions is intended to alter or restrict the operation of such provisions.
- Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising from them, shall be governed by and construed under the laws of the country in which the purchase was made. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction for any disputes or claims.
- Third-Party Rights
Only customers who made purchases have enforceable rights under these Terms and Conditions. Third parties do not have enforceable rights hereunder.
- Personal Data
By providing your personal data to us when purchasing goods or services, you confirm that you have read and agree for us to process your personal data in accordance with our Privacy Notice.
- Severability
If any provision of these Terms and Conditions is deemed invalid, it will be excluded to that extent, and the remaining provisions of these Terms and Conditions will remain in effect.
